Balochistan case|Government not following Article 148, says SC

QUETTA: A larger bench of the Supreme Court (SC) headed by Chief Justice Iftikhar Muhammad Chaudhry continued hearing the Balochistan law and order and missing persons’ cases at the Quetta Registry on Wednesday.

Principal Secretary of Prime Minister Khushnood Lashari and Defence Secretary Nargis Sethi and other government officials were also present during today’s proceedings.

The chief justice remarked that the government is not following Article 148 of the Constitution despite repetitive reminders. While addressing Khushnood Lashari, the CJ said that situation is the province is critical but government is not taking any steps according to the Constitution.

People are blaming Inter-Services Intelligence (ISI), Military Intelligence (MI), Frontier Corps (FC) and other law enforcement agencies (LEAs), the CJ said. Target killings are rampant in the province and police is helpless but no one is giving answers.

On this, PM’s Principal Secretary Khushnood Lashari replied that the government has initiated Aghaz-i-Haqooq-i-Balochistan Package on which the CJ asked him to visit the province to monitor the progress and said that peoples’ homes are burning.

The CJ said the court can give up all important assignments to resolve Balochistan issue.

Justice Khilji Arif asked the advocate general that how they can resolve the Balochistan issue as it is a burning matter. He remarked that we are trying to control this fire by playing our role.

CJ Iftikhar Muhammad Chaudhry on Tuesday said 80 percent of the allegations with regards missing persons were against the Frontier Corps (FC). He expressed displeasure over the absence of federal secretaries of defence and interior from the court proceedings.

This Monday, the Supreme Court had summoned the defence, interior and principal secretaries to the prime minister and the Balochistan governor to appear before the apex court on Tuesday in the missing persons’ cases. However, come Tuesday, they were missing from the court proceedings.

Deputy Attorney General Malik Sikandar was directed by the chief justice to do whatever it takes to recover the missing persons. But during Tuesday’s hearing, Sikandar informed the court that he became the attorney general because of certain circumstances and announced that he was resigning.

The CJ reminded the DAG of the relatives of missing persons who were waiting outside the court, adding that while the deputy attorney was with his children, the relatives of the missing persons were in agony because they had no news of their children’s whereabouts.

During the proceedings, the CJ noted that the police had shown no intention in recovering missing persons, saying that if the missing persons’ issue was resolved, 60 percent of Balochistan’s problems would be solved.

The SC summoned the Balochistan Home minister Mir Zafar Zehri to appear before the court on today in connection with a missing person, Ali Hassan Mengal, who is missing from district Khuzdar.

The deputy attorney general told the bench that he had delivered the court’s summons to the relevant authorities. The chief minister should have appeared before the bench himself, the chief justice said, adding that by this time, Raisani should have sacked six ministers from the Balochistan cabinet. “We want to save Balochistan…the law and order situation in the province is alarming and kidnappings and targeted killings are still going on,” Justice Iftikhar said.

The police have “failed to apprehend a single suspect” in these incidents, the CJ said, adding that allegations were continually being levelled against the Frontier Corps (FC) and Inter-Services Intelligence (ISI).

Justice Khilji Arif Hussain remarked that keeping in view the ongoing law and order situation of the province it was the responsibility of the federal government to appoint the most efficient officials in Balochistan rather than transferring the sitting proficient officers to other provinces. He directed the Pakistan Telecommunication Authority (PTA) to present details of SIMs issued by the authority in the province during the next hearing today.
